This ACCEPTABLE USE POLICY is to be read in conjunction with the EVP Terms of Use, EVP Privacy Policy found at www.voped.com. Subscription Agreement and the other documents referenced therein, all of these documents together form a binding agreement between VOPED and Subscriber. All subscribers to and users of VOPED’s Services and all visitors to VOPED’s website agree by their use to abide by this ACCEPTABLE USE POLICY; for the purpose of this Policy all users, including visitors, shall be included in the term “Subscriber.”

VOPED requires that all Subscribers conduct themselves as good citizens of the Internet and at all times act with respect for others. Each Subscriber is responsible for preventing violations of this ACCEPTABLE USE POLICY by third parties accessing the Service through Subscriber’s computers or accounts, including without limitation hackers and Subscriber’s own users.

A. The following activities are expressly prohibited:

In using the VOPED websites and services you accept and agree that the following actions are expressly prohibited by VOPED and that violators are subject to legal prosecution:

• Violating the security of any computer network
• Cracking or attempting to crack passwords or security encryption
• Transferring or storing illegal content and / or materials
• Uploading, emailing, and / or broadcasting hate speech or offensive, obscene, pornographic, threatening, libelous, defamatory, harassing or copyrighted material
• Uploading, emailing and / or broadcasting any “hate speech” material that is directed at a particular definable class
• Any illegal act or activity

Uploading videos and / or submitting comments or creating a profile or account through VOPED’s Service, with depictions of pornography, anything sexually explicit, violence, hate speech, or anything illegal or dangerous is prohibited. Violators shall be subject to prosecution by law.

Uploading videos and / or submitting comments or creating a profile or account through VOPED’s Service, with degrading, violence inciting hate speech, intimidating language or language which includes prejudiced speech or stereotypes about a particular definable class, gender, sexuality, ethnicity, national origin, religion or political affiliation is prohibited by VOPED. Violators are subject to prosecution by law.

Uploading videos and/or submitting comments or creating a profile or account through VOPED’s Service, that includes hate speech, or degrading, demeaning, threatening or harassing personal attacks is prohibited by VOPED. Violators are subject to prosecution by law.

B. Disruptions & Security:

VOPED may suspend Service in whole or in part if it reasonably suspects an ACCEPTABLE USE POLICY violation. Subscriber will reimburse VOPED for any expenses resulting from Subscriber’s violation of the ACCEPTABLE USE POLICY, including attorneys’ fees. VOPED may also disable Subscriber’s service if VOPED suspects that such service is the target of an attack or in any way interferes with services provided to other subscribers, even if Subscriber is not at fault. VOPED does not issue refunds for terminating service due to any of the reasons listed above. Subscriber is responsible for the use of its service, including use by hackers and other unauthorized third parties.

Except where VOPED specifically accepts such responsibility in Subscriber’s Registration (pursuant to the Terms of Use), Subscriber is responsible for maintaining any necessary security of its websites, including disaster recovery systems and backups. (Subscriber is advised to maintain its own backups outside of VOPED’s premises and systems, even if VOPED provides backups, security, or other services related to data protection.)

C. Reporting ACCEPTABLE USE POLICY Violations:

VOPED requests that anyone with information about a violation of this ACCEPTABLE USE POLICY, or of VOPED’s Terms of Use, report it by sending an email to vsupport@VOPED.com.
